Welcome to FolkAir. These Terms of Service (“Terms”) govern your access to and use of the FolkAir platform at folkair.com, operated by OnComp Ltd, a company registered in England and Wales with its registered office in London, UK.
By creating an account or using FolkAir, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
1. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement. If registering on behalf of a business, you confirm you have authority to bind that entity.
2. Account Responsibilities
- You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
- You must provide accurate, current, and complete information and keep it up to date.
- Notify us immediately at [email protected] if you suspect unauthorised access.
- You may not share, transfer, or assign your account without our prior written consent.
3. Platform Description
FolkAir is an events marketplace connecting venues, suppliers, agents, and event organisers. We provide tools for discovery, booking, contract management, scheduling, and payments.
FolkAir acts as an intermediary. We are not a party to contracts between users. We do not employ or endorse any supplier or venue.
4. Platform Fees
Fee rates are disclosed before you confirm any transaction. Fees may include:
- A service fee on bookings
- A commission or processing fee on supplier payouts
- Payment processing fees (passed through from Stripe)
We may update fees with reasonable notice. Current fees are visible in your dashboard.
5. Bookings & Contracts
Confirmed bookings form a binding agreement between relevant parties. FolkAir facilitates but is not a party to these agreements.
- All parties must honour confirmed bookings.
- Terms are as specified on the platform at confirmation.
- Changes must be agreed by all parties through the platform.
6. Cancellation & Refund Policy
- By the organiser/venue: The supplier's cancellation policy applies. Refunds depend on notice period and booking terms.
- By the supplier: May result in penalties, reduced visibility, or account restrictions.
- Platform fees: Generally non-refundable once confirmed, except as required by law.
- Force majeure: We will work with all parties toward a fair resolution.
7. Supplier Obligations
- Provide accurate service descriptions, pricing, and availability
- Maintain appropriate insurance, licences, and qualifications
- Fulfil confirmed bookings professionally
- Respond to enquiries in a timely manner
- Comply with all applicable laws and health & safety requirements
- Not solicit clients off-platform for FolkAir-originated bookings
8. Venue Obligations
- Provide accurate venue information
- Ensure a safe environment for suppliers and attendees
- Honour confirmed bookings
- Comply with licensing, fire safety, and health & safety regulations
- Process payments through the platform as agreed
9. Acceptable Use
You agree not to:
- Use FolkAir for any unlawful purpose
- Provide false or fraudulent information
- Harass, abuse, or harm other users
- Interfere with or disrupt the platform
- Attempt unauthorised access to accounts or data
- Scrape or crawl the platform without consent
- Post infringing, defamatory, or offensive content
- Circumvent platform fees via off-platform arrangements
10. Intellectual Property
All FolkAir content, features, and functionality are the property of OnComp Ltd or its licensors, protected by intellectual property laws.
You retain ownership of content you upload. By uploading, you grant us a non-exclusive, worldwide, royalty-free licence to use it in connection with operating the platform.
11. Dispute Resolution
We encourage parties to resolve disputes directly. FolkAir may offer mediation at its discretion. For disputes with FolkAir, contact [email protected].
12. Limitation of Liability
- FolkAir is provided “as is” without warranties of any kind.
- We do not guarantee quality, safety, or legality of listed services.
- We are not liable for indirect, incidental, special, or consequential damages.
- Total liability shall not exceed fees paid to us in the preceding 12 months.
Nothing excludes liability for death, personal injury from negligence, fraud, or liability that cannot be excluded by law.
13. Indemnification
You agree to indemnify OnComp Ltd from claims arising from your use of FolkAir, breach of these Terms, or violation of third-party rights.
14. Termination
- You may close your account at any time. Outstanding obligations must be fulfilled first.
- We may suspend or terminate your account for breach or fraud.
- Surviving provisions (liability, IP, indemnification) remain in effect after termination.
15. Changes to These Terms
We may update these Terms with at least 30 days' notice. Continued use after changes constitutes acceptance.
16. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
Consumers may also benefit from mandatory protection provisions of their country of residence.
17. Severability
If any provision is found invalid, the remaining provisions continue in full force. The invalid provision shall be modified to the minimum extent necessary.
